1. Validity; Scope

a. The subject of these General Terms and Conditions are all contractual relationships between GreenBox GmbH (hereinafter "We" or "GreenBox GmbH") and its contractual partners (hereinafter "Customer"). Our online shop is exclusively aimed at consumers.

b. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity. An entrepreneur is a natural or legal person or a legal partnership that acts in the exercise of its commercial or self-employed professional activity when concluding a legal transaction.

2. Subject of the Contract and Conclusion of Contract

a. The subject of the contract is the sale of goods offered in our shop. Further details, in particular the essential characteristics of the goods or services, can be found in the item description and the supplementary information on our website.

b. The purchase contract is concluded with GreenBox GmbH.

c. By placing products in our shop, we make a binding offer to conclude a contract. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after sending the order, you will receive a confirmation by e-mail.

3. Contract Language

a. The languages available for concluding the contract are German and English.

b. We store the contract text and send you the order data as well as our General Terms and Conditions in text form with the respective order confirmation.

4. Registration / Customer Account

a. Viewing and visiting the shop as well as all offer pages is generally free of charge and possible without registration.

b. Every customer is obliged to inform us immediately if there are indications that their access has been misused. Every customer is liable for all activities carried out using their access.

5. Use with the Berlin Green App

a. To fully use our products, downloading and using our Berlin Green App is required.
b. The use of the App is free of charge.
c. Setting up a user account is required for use.

6. Prices, Payment and Shipping

a. The prices are final prices including all taxes.
b. For orders from customers outside the EU, the customer must bear any applicable fees (e.g., customs duties).
c. We offer the following payment options: Credit Card, PayPal, Sofort by Klarna.
d. In the event of a cancellation, the customer bears the direct costs for returning the goods.
e. We only deliver by shipping. Self-collection of the goods is not possible.

7. Money-Back Guarantee

In addition to the statutory 14-day right of withdrawal, we offer a 30-day money-back guarantee. The customer can return the goods without giving reasons within 30 days of receipt if they cancel the contract within this period.

8. Retention of Title

The goods remain our property until full payment.

9. Shipping Damage

If goods are delivered with obvious shipping damage, please report it immediately to the delivery person and contact us. This has no effect on your statutory warranty rights but helps us with the processing with the carrier.

10. Warranty for Defects and Liability

The statutory warranty law for defects applies. We are liable without limitation for injury to life, body or health, as well as for intent or gross negligence.

11. Data Protection

Information on the collection and processing of personal data can be found in the separate data protection declaration.

12. Final Provisions

German law applies. The exclusive place of jurisdiction for all disputes is Berlin.

13. Alternative Dispute Resolution

The EU Commission provides a platform for online dispute resolution: http://ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

14. Right of Withdrawal

Instructions on Withdrawal

You have the right to withdraw from this contract within thirty days without giving any reason. The withdrawal period is thirty days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.

To exercise your right of withdrawal, you must inform us (GreenBox GmbH, c/o Eurohermes, Rauschwalder Straße 41, 02826 Görlitz, Germany, E-Mail: contact@berlingreen.com) of your decision to withdraw from this contract by means of a clear declaration (e.g., by letter or e-mail). You may use the attached sample withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Important note: Already used substrates including seeds (“Plant Plugs”) are excluded from exchange.

Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the delivery of goods that can spoil quickly or whose expiry date would be exceeded quickly (e.g., mushroom substrates).

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract.

For this reimbursement, we will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods.

You shall send back the goods without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You only have to pay for any diminished value of the goods if this diminished value is due to handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
